History:
The 1997 Zoning Ordinance specifies that the Planning Board must approve all multi-family permits in the Rural and Village Districts. This also means that the Planning Board must advertise and hold a public hearing before the permit may be issued. The CEO currently has the authority to issue multi-family permits in the Commercial District. This proposal would allow the CEO is issue such permits and no public hearing would be required.
Please note that unless exempted by state law, all multi-family units with three or more dwelling units are required to be reviewed by the Planning Board under the local and state subdivision regulations. Therefore, this change will usually only affect duplex dwelling units. If subdivision review is required, at least one public hearing must be advertised and held.
Since the March 1997 law took effect, the Planning Board has authorized one single family building to be converted into a two-family dwelling and has approved a subdivision consisting of five two-family dwellings.
This change was proposed by the Limington Code Enforcement Officer (CEO), Freeman Abbott.
