WIRELESS TELECOMMUNICATIONS ORDINANCE

A. The purpose of these standards is to provide for the appropriate location and development of communications towers, antennae and equipment to provide the most comprehensive service possible to all residents, businesses and visitors to the Town of Limington in a manner which minimizes the visual, environmental, and safety impacts through careful design, siting, and landscaping.

DESIGN CRITERIA
The tower shall be a free-standing monopole design. Lattice style towers and similar facilities requiring three or more legs and/or guy wires for support are not allowed unless the Board determines that based on specific findings of fact that a monopole is not suitable for the location and that the best interest of the Town will be served by the construction of a lattice style tower.

Carrier Capacity:
Wireless telecommunications towers shall be designed to accommodate three (3) carriers. The intent of this requirement is to reduce the number of facilities which will be required to be located within the community.

Finish/Paint:
The tower shall remain unpainted galvanized steel or be painted gray or silver.

Fencing:
Fencing shall be provided to control access to wireless telecommunication facilities and shall be compatible with the scenic character of the Town. There shall not be no razor wire used unless it is requested by the Town Fire Chief and/or local police authority.

Parking:
There shall be a minimum of one parking space for each facility, to be used in connection with the maintenance of the site, and not to be used for the permanent storage of vehicles or other equipment.

Landscaping:
Landscaping and other screening shall be used to minimize visibility from contiguous properties. Where natural buffering exists for a distance of 500 feet around the base of the monopole or tower, no landscaping is required.

SETBACKS
The tower shall be set back from all property lines a distance equal to one hundred and fifty percent (150%) of its height.

APPLICATION CRITERIA
Viewshed Analysis: A color rendition of the proposed monopole or tower with its antenna and/or panels shall be submitted with the application. A rendition shall also be prepared illustrating a view of the monopole, tower, dish and/or antennas from the nearest street or streets with a viewshed analysis report.

Engineering Justification: Applications for wireless telecommunications facilities shall include engineering justification for the need, location and height. The proposal shall provide the broadest possible service to all areas and all potential users within the Town.

COLLOCATION
Wherever possible, wireless telecommunications equipment installations shall be placed on existing monopoles, towers, tanks, roofs, signs, or other existing manmade or natural features to make the equipment inconspicuous.

Collocation shall be maximized and new wireless telecommunications facilties shall be minimized. New facilities shall only be considered after a finding that existing or previously approved facilities cannot accommodate the proposed user(s). The Board may require for new facilities that the applicant provide an agreement to cooperate with collocation of additional carriers at industry standard rates and to complete a written agreement with additional carriers within six (6) months of the receipt of a collocation application.

FAA, FCC ANSI COMPLIANCE

Applications for wireless telecommunications facilities will include a written statement that the proposed facility complies with or is exempt from applicable regulations administered by the Federal Aviation Administration (FAA), the Federal Communications Commission (FCC), and with the American National Standards Institute (ANSI).

Lighting of 'Lowers shall be prohibited unless required by the Federal Aviation Administration. Lighting shall be limited to that needed for emergencies and/or as required by the FAA.

ACCESS ROADS
Roads constructed to access wireless facilities shall meet or exceed the Town's subdivision review standards in all zoning districts. Requirements with regard to slope, as contained in other sections of the Ordinance, shall not apply to wireless telecommunications facilities.

BOND
The Planning Board shall require the applicant to post a bond acceptable to the Town in an amount sufficient to pay the cost for the removal of the facility. Wireless telecommunications facilities which have been abandonned or which have remained unused for a periond of twelve (12) consecutive months shall be removed.

WAIVER AUTHORITY
The Planning Board may waive specific requirements and limitations contained herein upon a finding that the waiver provides an equal or greater conformance with the intent of this Ordinance.

***ADD TO SECTION 2.2: DEFINITIONS

Antenna:
    Any exterior apparatus designed for telephonic, radio, television, personal communications service (PCS), pager network, or any other communications through the sending and/or receiving of electromagnetic waves of any bandwidth whether it be integral to a tower, microwave or satellite dish structure. Those facilities which are used only for the reception of television or radio signals are exempt from the requirements of this Ordinance.

Communications Tower:
    Any structure that is designed and constructed primarily for the purpose of supporting one or more antennas, including self-supporting or guyed lattice towers and monopoles. The term includes radio and television transmission towers, microwave towers, common-carrier towers, cellular telephone towers, alternative tower structures, and the like.

Dish:
    Any parabolic or spherical microwave antenna reflecting surface structure used for telecommunications

Essential Services:
(To be filled in by Planning Board)

Wireless Telecommunications Facilities:
    Any antenna, satellite dish, microwave dish or equipment used for the receiving, relaying or transmitting of radio, telephone, television, or any other electromagnetic based communication or data transfer, or any tower, pole or structure supporting such equipment.
